Fox News legal analyst Andrew Napolitano on Wednesday argued that there is “undisputed evidence” that President Trump abused the power of his office in his dealings with Ukraine, asserting that the “remedy of impeachment is acutely needed” because of it.
“In Mr. Trump’s case, we have undisputed evidence that he abused his power by inviting a foreign government to interfere in the 2020 presidential election and then compounded this by directing subordinates to refrain from giving congressionally commanded evidence of his behavior,” Napolitano, a fierce Trump critic, wrote in a Washington Times op-ed ahead of the House vote on articles of impeachment.
The article goes on to state the following:
Napolitano’s op-ed focuses largely on the rule of law and how it pertains to a sitting U.S. president. While acknowledging that a sitting president cannot be prosecuted in office, he describes impeachment as a constitutional remedy for behavior that “subverts our democratic institutions.”
High crimes and misdemeanors is a basis for impeachment, the constitutional remedy for presidential behavior that subverts our democratic institutions.
It is undisputed that Mr. Trump withheld the delivery of the $391 million in military aid to Ukraine that Congress authorized and ordered and that Mr. Trump himself signed into law. He said he withheld that aid because he first wanted “a favor” from the president of Ukraine. The favor, requested by others on Mr. Trump’s behalf, was the announcement of a Ukrainian government criminal investigation of Mr. Trump’s potential political adversary, former Vice President Joe Biden.
In the language of the streets, this is a shakedown; it sought to enhance Mr. Trump’s personal political needs and bears no relationship to American foreign policy.
According to the Fox analyst, Trump’s “behavior implicates two crimes”:
- The federal prohibition on soliciting campaign aid from a foreign government
- Bribery, which is the exploitation of public duties for personal gain

DML News App Founder Dennis Michael Lynch weighed in on impeachment, saying Democrats have made a big mistake.
“It’s always been the plan to impeach this present,” Lynch said. “Since the day he started. The news outlets, [House Speaker] Nancy Pelosi, they’ve all had one agenda: impeach the president.”
Lynch said Pelosi caved to the pressure of the media and progressive Democrats who were pushing for impeachment, making a “gross” mistake by ignoring the polls and American voices.
“The president’s poll numbers since this impeachment stuff started have gone up,” Lynch said. “The reason they’ve gone up is because of Independents.”
Lynch said Independents don’t care about politics or parties, they care about the safety and security of their families, and they just want someone to get something done in Washington.
“The economy is roaring. We have other problems, but [Democrats] aren’t even remotely trying to solve these problems,” Lynch said. “Stop this impeachment stuff and start fixing the country. And after a while, you can’t blame Trump for it, no matter how much you may want to or like to. This is a Democrat problem.”
